1. Definitions

• The Platform / We / TakeTheme: a software-as-a-service (SaaS) platform for building and managing online stores.
• The Services: all tools, pages, functions, application programming interfaces (APIs), and integrations.
• The User / You: any natural or legal person who creates an account or uses the Services.
• The Merchant: a User who creates a store through the Platform.
• The Merchant's Customers: visitors and buyers of stores built on the Platform.

2. Eligibility and Account Creation

• You must be at least 18 years old.
• You agree to provide accurate, up-to-date information and not to share your login credentials.
• You are responsible for all activity carried out through your account.

3. Permitted Use and Prohibited Activities

Users are prohibited from:

• Selling or promoting goods/services that violate the law.
• Infringing intellectual property rights or imitating stores/brands.
• Providing misleading information or impersonating others.
• Planting malware or carrying out cyber attacks.
• Abusing the APIs or exceeding reasonable request rate limits.
• Any activity that is unlawful locally or internationally, or destructive/non-commercial in nature.

Action: we reserve the right to suspend or terminate the account without prior notice upon violation of any of these terms.

4. Plans, Fees, and Subscriptions

• Monthly and annual plans are available and renew automatically unless cancelled before the renewal date.
• Local taxes and fees may apply.
• Failed payment may lead to suspension of the Services or restriction of features.

5. Intellectual Property

• All rights are reserved to TakeTheme, including code, designs, trademarks, logos, and documentation.
• Copying, modifying, or reusing any part of the Services without prior written consent is prohibited.

6. APIs & Integrations

• Use of integrations and third-party services is subject to their providers' terms.
• TakeTheme is not liable for any indirect damages arising from the use of third-party services.

7. Disclaimer and Limitation of Liability

• The Services are provided “as is” and “as available.”
• We do not guarantee that the Service will be error-free or uninterrupted.
• TakeTheme is not liable for any indirect, consequential, or incidental damages, or loss of profit.

8. Indemnification

You agree to indemnify TakeTheme, its affiliates, and its employees against any claims arising from your violation of these terms or misuse of the Services.

9. Governing Law and Dispute Resolution

The laws of the Arab Republic of Egypt apply, and the courts of Cairo have jurisdiction.

10. Amendments

We may update these terms. The amended version takes effect once published.
